Account Registration and Usage:

You must be at least 18 years old to use the Service. By using the Service, you agree to provide accurate and complete information during the registration process and to keep your account information up to date. It is your responsibility to maintain the confidentiality of your account credentials. You are solely responsible for all activities that occur under your account, and you may not share your account credentials or allow others to access your account.

Intellectual Property:

The Service, along with its original content, features, and functionality, is owned by the Company and is protected by international copyright, trademark, patent, and other intellectual property laws. You are not permitted to modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products, or services obtained from the Service without prior written permission from the Company.

Prohibited Use:

You are prohibited from using the Service for any illegal, unauthorized, or prohibited purposes. Any activity that disrupts or interferes with the proper functioning of the Service, including the introduction of viruses, malware, or other harmful code, is strictly prohibited. Unauthorized attempts to access the Service, other users’ accounts, or any associated systems or networks are not allowed.

Data Privacy

The Company respects your privacy and manages your personal information in accordance with its Privacy Policy. Your use of the Service implies your consent to the collection, use, and disclosure of your personal information as described in the Privacy Policy.

Limitation of Liability

You explicitly understand and agree that Zestpush, its subsidiaries, affiliates, and licensors shall not be liable to you, whether in contract, tort (including negligence), for breach of statutory duty, or otherwise, under or in connection with this agreement. This includes but is not limited to any indirect, incidental, special, consequential, or exemplary damages, loss of profit (whether incurred directly or indirectly), loss of goodwill or business reputation, loss of data, cost of procurement of substitute goods or services, or any other intangible loss that may be incurred by you. This applies irrespective of how it is caused and under any theory of liability.

Termination:

The Company reserves the right to suspend or terminate your access to the Service at any time and for any reason, including, but not limited to, your violation of these Terms. Upon termination, your right to use the Service will cease immediately, and you are required to discontinue any further use of the Service.

Exports and installation:

If your account is on the free plan, you can request data export only once per month. For users on the premium plan, you are allowed to request data export three times per month. However, for users on the self-host plan, there are no restrictions on the frequency of data exports, except for full database exports, which are limited to once per month.
Under the self-host plan, you will have access only to the Zestpush dashboard, allowing you to view your server status and utilize the platform as desired. However, due to code security and performance reasons, direct server access cannot be provided. Upon request, access to the database can be granted.
You have the flexibility to change your server at any time.

Governing Law:

These Terms will be governed by and interpreted in accordance with the laws of the jurisdiction where the Company operates. Any disputes arising from or related to these Terms or the Service will be resolved through binding arbitration following the rules of the relevant arbitration organization.

Our refund policy

Our policy is valid for a period of 14 calendar days from the date of the purchase. If you are not satisfied with the product, you can ask for a refund. If the period of 14 days has lapsed since the purchase, we can’t, unfortunately, offer you a refund.

Additional services

Please note that any additional services like setup coast in selfhost, custom work or technical support are non-refundable as our time cannot be recovered.

Payment policies

If you have checked out a premium pay-as-you-go plan or have subscribed to a self-host plan, and have added your credit card information for payment, we reserve the right to charge the due amount from your registered payment method based on our billing cycle. In case of insufficient funds in your account, you will be notified, and a specific deadline for payment will be provided. Failure to complete payment by the specified date may result in the suspension of services or revocation of server access.
If payment is not made even after the service has been suspended, your service may be subject to deletion, and we will not be held responsible for any data or information stored within.
Please note that if your service has been suspended, backup requests may not be accommodated.
If you have subscribed to our pay-as-you-go plan, you will be familiar with our pricing model, where we charge based on token numbers initially and later assess charges based on your usage cases from the previous month. At the end of each month, we may charge your account for usage cases without prior notice. Additionally, if your usage exceeds a certain threshold or if the credit count in your account falls below a certain limit, we reserve the right to charge your account at any time to maintain a threshold balance. Failure to maintain this balance may result in the discontinuation of services.

Affiliate Terms and Conditions:

1. Participation in the Zestpush Affiliate Program:

By joining the Zestpush Affiliate Program, you agree to comply with the following terms and conditions. These terms govern your participation in the program and your eligibility to earn affiliate commissions.

2. Eligibility:

To be eligible for the Zestpush Affiliate Program, you must be at least 18 years old and have a valid PayPal or bank account to receive commission payments. Affiliates from all countries are welcome to participate.

3. Affiliate Commissions:

As an affiliate, you will earn a flat 15% commission on each sale referred through your unique affiliate link. Commissions will be based on the net sale amount after any discounts or refunds. The commission structure is subject to change at the discretion of Zestpush.

4. Payout Schedule:

Affiliate commissions will be paid out on a Net15 and Net30 basis. This means that commissions earned within a given month will be paid out 15 or 30 days after the end of that month. Payments will be made via your chosen payment method, such as PayPal or bank transfer.

5. Minimum Payout Threshold:

The minimum payout threshold for affiliate commissions is $50. Commissions must reach or exceed this amount before being eligible for payout. If your earnings do not meet the minimum threshold in a payment cycle, they will roll over to the next cycle until the threshold is reached.

6. Promotion and Marketing:

As an affiliate, you are encouraged to promote Zestpush using ethical and legal marketing methods. You may use your unique affiliate link on your website, blog, social media channels, or other appropriate platforms. However, the following promotional activities are strictly prohibited:
– Spamming or unsolicited email marketing
– Misleading or deceptive advertising
– Promotion on adult or illegal websites
– Brand Name Infringement

7. Affiliate Tracking:

Zestpush provides affiliates with a dedicated affiliate dashboard to track referral clicks, conversions, and commissions. It is your responsibility to ensure that your affiliate links are properly formatted and tracked to ensure accurate commission attribution.

8. Compliance with Laws:

As an affiliate, you agree to comply with all applicable laws and regulations while promoting Zestpush. This includes but is not limited to data privacy laws, anti-spam regulations, and intellectual property rights.

9. Termination:

Zestpush reserves the right to terminate your affiliate account and withhold any pending commissions if you are found to be in violation of these terms and conditions or engage in fraudulent activities.

10. Modification of Terms:

Zestpush reserves the right to modify or update these affiliate terms and conditions at any time. Affiliates will be notified of any changes, and it is their responsibility to review and comply with the updated terms.
